Terms of Service

These Terms of Service ("Terms") govern your use of Peak Rebate ("Service"), operated by Peak Rebate LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Peak Rebate provides HVAC and plumbing equipment verification, rebate eligibility screening, and claim preparation tools for licensed contractors. The Service includes model lookups via SMS and web for heat pumps, furnaces, and heat pump water heaters, HEAR program eligibility checks, document collection, AHRI certificate lookups, and PDF claim summary generation.

        Important: Peak Rebate is a verification and claim preparation tool. We do not guarantee rebate approval, payment amounts, or program availability. Final rebate decisions are made solely by the applicable program administrators (e.g., Xcel Energy, Colorado HEAR program).
    

2. Service Scope

Peak Rebate assists HVAC and plumbing contractors by verifying ENERGY STAR certification for heat pumps, furnaces, and heat pump water heaters, checking Colorado rebate program eligibility (including HEAR), and preparing rebate claim documentation packages. Contractors remain responsible for verifying current program requirements and submitting completed claims to the applicable rebate administrator (e.g., Xcel Energy, Colorado HEAR program). Peak Rebate does not submit claims on behalf of contractors and does not guarantee rebate approval, payment amounts, or program availability.

3. Eligibility

The Service is intended for use by licensed HVAC and plumbing contractors and their authorized representatives operating in the state of Colorado. By using the Service, you represent that you are a licensed contractor or authorized representative thereof.

4. Account and Access

Free lookup features do not require an account. Paid features (claim filing, Pro, and Enterprise tiers) require registration with a valid email address and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Pricing and Payment

Current pricing tiers are published on our website and may be updated with 30 days' written notice. Per-claim fees are charged upon claim submission. Monthly subscription fees are billed in advance. All fees are non-refundable except as required by law.

6. Data Accuracy

Peak Rebate sources HVAC and plumbing equipment data from publicly available databases including ENERGY STAR, the AHRI directory, and Colorado state records. While we strive for accuracy, we do not warrant that all data is complete, current, or error-free. You are responsible for verifying information before relying on it for business decisions or customer representations.

7. No Guarantee of Rebate Approval

The Service provides eligibility estimates based on publicly available program criteria. We do not guarantee that any rebate claim will be approved or paid. Rebate programs have independent qualification requirements, funding limitations, and approval processes beyond our control. Peak Rebate shall not be liable for denied claims, reduced rebate amounts, program changes, or funding exhaustion.

8. Homeowner Information

When using the claim filing features, you may submit homeowner information including names, addresses, and installation details. By submitting this information, you represent that you have obtained appropriate consent from the homeowner to share their information with Peak Rebate for the purpose of claim preparation. 9. SMS Terms and Conditions

By initiating a text message conversation with Peak Rebate regarding HVAC or plumbing equipment verification, you agree to the following:

Consent: You consent to receive automated SMS messages from Peak Rebate related to equipment verification, rebate eligibility, claim filing, payment confirmations, and service-related communications.
Not required for purchase: Consent to receive SMS is not a condition of purchasing any service. You may use the website-based checkout without providing a phone number.
Message frequency: Varies based on your usage. Typically 2-10 messages per interaction session.
Message and data rates: Standard message and data rates from your mobile carrier may apply.
Opt-out: Reply STOP at any time to stop receiving messages. Reply HELP for assistance.
Privacy: Your phone number will not be sold or shared for marketing. See our Privacy Policy for full details.

10. Acceptable Use

You agree not to:

Submit false or misleading equipment information
File fraudulent rebate claims
Submit homeowner information without proper consent
Attempt to reverse-engineer, scrape, or overload the Service
Resell or redistribute access to the Service without authorization
Use the Service for any unlawful purpose

11. Intellectual Property

The Service, including its design, features, and content, is owned by Peak Rebate LLC. You retain ownership of any data you submit through the Service. By submitting data, you grant us a limited license to process and store it solely for the purpose of providing the Service.

12. Limitation of Liability

To the maximum extent permitted by law, Peak Rebate LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost rebate revenue, denied claims, or business losses. Our total liability for any claim arising from the Service shall not exceed the fees you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Peak Rebate LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your submission of inaccurate or unauthorized information.

14. Termination

Either party may terminate the relationship at any time. We may suspend or terminate your access for violation of these Terms. Upon termination, we will retain your data for 90 days to allow for retrieval, after which it will be permanently deleted unless a longer retention period is required by law.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or notice on the Service at least 30 days in advance. Continued use after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of Denver County, Colorado.
